THE COSTA RICA PROPERTY PURCHASE PROCESS

A well-structured purchase should feel less like a maze and more like a sequence of clear decisions.

While the exact legal and financial steps depend on the property and transaction, most buyers benefit from understanding the role of five basic stages: selection, due diligence, agreement, transaction handling and closing.

1. CHOOSE THE RIGHT PROPERTY

The process begins before paperwork. Understand the residence, location, community structure, current availability and how the home fits the way you intend to use it.

2. COMPLETE LEGAL DUE DILIGENCE

Before a binding purchase, qualified counsel should review the property and relevant transaction documents. Depending on the property, this may include title information, cadastral records, recorded encumbrances, development or condominium documents and other legal matters relevant to ownership.

3. FORMALIZE THE AGREEMENT

The purchase and sale agreement establishes the contractual relationship between buyer and seller or developer. It should define the obligations, timelines, payment milestones, closing conditions and other terms that govern the transaction.

Marketing materials can help a buyer understand a project. The signed legal documents are what govern the purchase.

4. FOLLOW THE APPROVED PAYMENT AND ESCROW PROCESS

Where escrow is used, the escrow agreement and instructions should define how funds are received and handled. In a development purchase, payments may also correspond to contractual milestones.

5. CLOSE AND REGISTER OWNERSHIP

Closing formalizes the transfer or acquisition in accordance with the transaction documents. Counsel then handles the legal instruments and registration steps applicable to the property.
